Welcome to JJfootwear.com. If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern JJ Footwear’s relationship with you in relation to this website.

You should PRINT a copy of these terms and conditions for future reference.

Before placing an order with us you will be required to accept these terms and conditions. You can refuse to accept these terms and conditions, but please understand that if you refuse to accept these terms and conditions, or our Privacy Policy, you will not be able to order any Products from our site. JJ Footwear has the right to change these Terms and Conditions at any point in time.

1. Who is JJ Footwear?
1.1`www.jjfootwear.com (we) is a web store operated by JJ Footwear, a Dutch shoe company. JJ Footwear is the trademark of ‘JJ Shoes B.V.’. JJ Footwear is registered in The Netherlands, under number 18129916 0000 of the Dutch chamber of commerce. Our physical address is: Sprangseweg 13c, 5144 NV Waalwijk, The Netherlands.

2. Legally capable of entering into binding contracts
2.1 By placing an order through our site, you warrant that YOU are legally capable of entering into binding contracts.

3. Contract between YOU and JJ Footwear
3.1 If you decide to order any of our Products from this website, you can select the products to be ordered, which will be included in your “Shopping Cart”. The web shop will link with our stock database to confirm whether the selected products are available in stock (any order is subject to availability). You will then be requested to submit your personal and payment details, you will not be charged for the Products as yet. After placing an order, you will receive an order confirmation from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to check clearing or credit card approval and to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been despatched (the Despatch Confirmation). The contract between us (Contract) will only be formed, and you will only be charged, when we send you the Despatch Confirmation.
3.2 Before placing an order a window will appear on the screen asking you to confirm the order and the information provided to us, so you can correct input errors before placing your order.
3.3 The contract will relate only to those products whose despatch we have confirmed in the Despatch Confirmation. We will not be obliged to supply any other Products which may have been part of your order until the despatch of such Products has been confirmed in a separate Despatch Confirmation.

4. Links on www.jjfootwear.com and www.jjfootwear.co.uk
4.1 We may also provide links on our site to the websites of other companies, whether affiliated with us or not. We cannot give any undertaking, that products you purchase from third party sellers through our site, or from companies to whose website we have provided a link on our site, will be of satisfactory quality, and any such warranties are DISCLAIMED by us absolutely. This DISCLAIMER does not affect your statutory rights against the third party seller.

5. Your rights as a costumer
5.1 You may cancel a Contract at any time within ten (10) days, beginning on the day after you received the Products. In this case, you will receive a full refund of the price paid for the Products in accordance with our returns and refunds policy set out in Clause nine (9) below.
5.2 To cancel a Contract, you must inform us in writing using our returns form and return the products to us immediately, in the same condition in which you received them, and at YOUR OWN cost and risk as set out in Clause nine (9) below.
5.3 This provision does not affect your statutory rights.

6. Delivery and shipment
6.1 Subject to products availability, JJ Footwear aims to deliver goods within 15 working days of receipt of order for USA Standard deliveries. Your order will be fulfilled by the delivery date set out in the Despatch Confirmation or, if no delivery is interrupted or slowed down, you will be contacted by us. Events that can interrupt or slow down the delivery are specified in Clause 14. Your credit card will not be debited with the transaction until your goods are ready for despatch and you receive the Despatch Confirmation. However, for multiple orders, we may charge you upfront for the costs for the delivery of Products that you ordered but are temporarily out of stock. In this case, you will not be charged upfront for such Products until they become available and are despatched to you.
6.2 Replacement with different soles or changing the heel will invalidate JJ Footwear’s guarantee of reasonable wear and tear. JJ Footwear boots are designed to not take any other soles or heels other than it's own. Please note that JJ Footwear is specially manufactured for use with orthotics.
6.3 We have tried our utmost to portray the detail, colors and leather texture of the boots correctly. However, due to photographic variation and computer settings please allow for slight variation.

7. Risks and ownership
7.1 The products will be at your risk from the time of delivery.
7.2 Ownership of the products will ONLY pass to you when we receive full payment of all sums due in respect of the products, including delivery charges.

8. Price adjustments and paying
8.1 Fluctuation of the price over the year is possible. JJ Footwear keeps the right to adjust errors in the pricing. Prices are liable to change at any time, changes of price will not affect orders already placed and received a Despatch Confirmation. In other circumstances the new prices will be used.
8.2 These prices are excluding TAX but inclusive delivery costs (normal shipment method), which will be added to the total amount due for each product ordered as set out in our Delivery Guide.
8.3 Our site contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. We will normally verify prices as part of our despatch procedures so that, where a product's correct price is less than our stated price, we will charge the lower amount when despatching the product to you. If a product’s correct price is higher than the price stated on our store, we will normally, at our discretion, either contact you for instructions before despatching the product, or reject your order and notify you of such rejection.
8.4 We are under no obligation to provide the Product to you at the incorrect (lower) price, even after we have sent you a Despatch Confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as a mispricing.
8.5 Payment for all products must be in American Dollars or Euro`s, debit or credit card. We accept payment provided by PayPal, for example: Visa, Mastercard and American Express.

9. OUR RETURNS AND REFUNDS POLICY
9.1 A returned Product will be examined by us. We will notify you within a short period of time about your request for refund of exchange. This will be handled via e-mail. Our goal is to process the returns as soon as possible. If your request is approved we will inform you as soon as possible. New products will be sent immediately and money will be refunded within ten (10) days.
9.2 If you are not satisfied with your Product you are allowed to return your order to us within ten (10) days after receipt. Products can only be returned unworn and undamaged. The original packing together with the original purchase receipt is returned also. If so, you will get a full refund. Shipping costs are not refundable and are to be paid by the customer.
9.3 Process of return: Fill in the Returns Form included in the package. Indicate clearly whether you like to exchange the Product of get a refund. Use the original shoe box with the tissue paper intact. Send the shoes in the original box back to us. Make use of the returns label that we provided. Fill in the Returns Form and include this in the box. Make use of the nearest post station or use your own transportation method. Special delivery with tracking options is recommended, also as insurance is. The returning costs are not refundable.
9.4 We take the best care of our Products before they are sent to you. All Products and boxes are checked before transportation. JJ Footwear guarantees customers that the boots will retain their quality during their reasonable life expectancy, as long as they are used and maintained correctly. Refund or exchange will be denied when the boots are found to be worn, marked, damaged, scratched of marked. JJ Footwear cannot guarantee against standard wear and tear. The right to seek a second opinion from an independent body is reserved by JJ Footwear. In case of manufacturing defects we will offer an exchange or a refund. Minor faults within six (6) months of purchase will be repaired. If we are unable to repair the product we will offer an exchange or a refund. Repair, refund and exchange claims will be assessed independently. Your statutory rights are not affected. Original packaging is required for returned Products. JJ Footwear reserves the right to deduct repackaging value of the products not returned in their original packaging. The original documentation for credit purpose and a clear statement of the reason for refund are required. Refund and exchange requests are not granted for Products returned without a returns form. A traceable and insured postal service is advised when you return the products to us. Or follow the International Returns instructions included in your parcel. Postal charges for returns are to be paid by the customer. Postal chargers for the delivery of exchanges are the responsibility of the customer and cannot be refunded.

10. OUR LIABILITY
10.1 JJ Footwear guarantees that the Products on the web store are fit for purpose and have a satisfactory quality.
10.2 Our liability in connection with any Product purchased through our site is strictly limited to the purchase price of that Product.
10.3 This does not include or limit in any way our liability:
10.3.1 For death or personal injury caused by our negligence;
10.3.2 Under section 2(3) of the Consumer Protection Act 1987;
10.3.3 For fraud or fraudulent misrepresentation; or
10.3.4 For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
10.4 We accept no liability for any loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management or office time or for any indirect or consequential loss or damage of any kind however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable. .

11. WRITTEN COMMUNICATIONS
11.1 Applicable laws require that some of the information or communications we send to you should be written. When using www.jjfootwear.com, you accept that electronic communication will be used mostly. Posting notices will be provided to you by e-mail. For contractual purposes, you agree to the electronic communication and you acknowledge that all contracts, notices, information and other communications that are provided to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

12. NOTICES
12.1 All notices given by you to us must be directed to JJ Footwear at Prof. Asserweg 20, 5144NC Waalwijk, The Netherlands. We may notify you by e-mail or via your postal address, that you provided to us, by placing a order or any of the ways specified in Clause 11. Notice will be deemed received and properly served immediately when posted on our webshop, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

13. TRANSFER OF RIGHTS AND OBLIGATIONS
13.1 The contract of purchase is binding between you and JJ Footwear and on our respective successors and assigns.
13.2 You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent.
13.3 We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.

14. EVENTS OUTSIDE OUR CONTROL
14.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event), including (without limitation) the following:
14.1.1 Strikes, lock-outs or other industrial action.
14.1.2 Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
14.1.3 Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
14.1.4 Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
14.1.5 Impossibility of the use of public or private telecommunications networks.
14.1.6 The acts, decrees, legislation, regulations or restrictions of any government.
14.2 Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event. br>
15. WAIVER
15.1 If we fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.
15.2 A waiver by us of any default shall not constitute a waiver of any subsequent default.
15.3 No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with Clause 12.

16. SEVERABILITY
16.1 If any of these terms and Conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

17. ENTIRE AGREEMENT
17.1 These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
17.2 We each acknowledge that, in entering into a Contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such Contract except as expressly stated in these terms and conditions.
17.3 Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made fraudulently) and the other party’s only remedy shall be for breach of contract as provided in these terms and conditions.

18. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS
18.1 JJ Footwear has the right to revise and amend these terms and conditions at any time.
18.2 You will be subject to the policies and terms and conditions in force and posted onto our web store at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Despatch Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Products).

19. LAW AND JURISDICTION
19.1 Contracts for the purchase of Products through our site will be governed by Dutch law. Any dispute arising from, or related to, such Contracts shall be subject to the non-exclusive jurisdiction of the court of the Netherlands.
